Terms of Service

1. Object

This document regulates the conditions of access and use of the website operated under the trademark "Kode Engine", as well as the conditions applicable to commercial requests made by users through it.

2. Nature of Service

The website displays information related to motorcycles and components, both new and used, mainly intended for competition use, for informational and commercial purposes.

There is no direct purchasing system or integrated payment gateway on the website. Sales operations are formalized individually outside the website environment, through direct communication between the user and Stylobike 2010 S.L. (e.g., WhatsApp or email).

2.1. Consumers and Business Buyers

These Terms apply both to consumers (private individuals purchasing outside any professional activity) and to business or professional buyers (racing teams, workshops, dealers and any non-consumer buyer).

The mandatory consumer-protection rights referred to in these Terms — in particular the legal guarantee of conformity and the right of withdrawal — apply only where the buyer is a consumer. Business and professional buyers purchase under the conditions expressly agreed for each sale, and those statutory consumer rights do not apply to them.

3. Seller

The final seller of all products offered is Stylobike 2010 S.L., which acts as the contracting party, issues the corresponding invoice, and assumes the legal and fiscal obligations arising from the sale.

"Kode Engine" acts solely as a trademark and does not constitute an independent legal entity.

4. Sale Process

The sale process consists of the following phases:

1. User browses website and expresses interest via WhatsApp or contact form.
2. Stylobike 2010 S.L. provides detailed product information, condition, and availability through direct communication outside the website.
3. User confirms acceptance of final price and shipping terms.
4. Payment is arranged (bank transfer, PayPal, or cash where legally permitted).
5. Stylobike 2010 S.L. issues the corresponding invoice and dispatches the product as soon as reasonably possible after payment confirmation; the estimated dispatch time is confirmed for each order.
6. Shipping costs and insurance are the buyer's responsibility unless otherwise agreed.

Important: All communication and sales are conducted directly with Stylobike 2010 S.L., not through automated systems. Each sale is personalized to ensure customer satisfaction.

5. Product Information

Descriptions and photographs are for guidance only. The definitive information about the specific condition of the product is provided individually before the operation is finalized.

6. Prices and Availability

Published prices are indicative and non-binding. The final price and availability will be expressly confirmed before formalizing the sale.

7. Used and Competition Products

The user declares to know and accept that certain products:

1. Are second-hand and may show prior wear.
2. Have a limited lifespan due to their nature as competition equipment.
3. Are not approved for use on public roads.
4. Are subject to the demands of competition use.

Products are sold "as-is" based on the condition described at the time of sale. The buyer acknowledges the inherent risks of competition products and the possibility of normal wear from previous use.

8. Warranty Policy

Consumers (private individuals). Where the buyer is a consumer, the legal guarantee of conformity provided by applicable law applies. As these are second-hand goods, the parties may agree a reduced guarantee period, which will not be shorter than one (1) year from delivery.

This guarantee covers only hidden defects — that is, a lack of conformity that already existed at the time of delivery and was not visible, not reasonably apparent on inspection, and not disclosed in the product description. In particular, it does NOT cover:

1. Normal wear resulting from the product's prior competition use.
2. The limited lifespan inherent to competition equipment.
3. Any condition, defect or wear that was disclosed, described, photographed or otherwise visible before the sale.
4. Any damage, breakage or malfunction arising after delivery from use, installation, modification, or the normal risks of competition.

Business and professional buyers (racing teams, workshops, dealers and any non-consumer buyer). Used motorcycles and used parts are sold strictly "as-is", based on the condition described at the time of sale, without any commercial warranty and without returns, replacements or exchanges.

New Products: For brand-new competition motorcycles and parts, the warranty offered by the manufacturer applies, when available.

Important Note: We make every effort to describe each product accurately — including its actual condition, usage history, and any known defects — so that the buyer purchases with full information.

8.5. Shipping and Insurance

Shipping Timeframe: Products are normally dispatched within a few business days after payment confirmation; the specific timeframe is confirmed for each order, with tracking information provided via email.

Insurance: Optional but highly recommended. Stylobike 2010 S.L. is NOT responsible for loss or damage during shipping if the buyer declines insurance coverage. We always offer and recommend full risk or CMR insurance for valuable items.

Buyer Pickup: If the buyer arranges their own transportation or pickup, Stylobike 2010 S.L. is NOT responsible for any issues arising after the product leaves our facilities.

International Shipping: Import duties, taxes, customs clearance, and any related fees are the buyer's responsibility. Shipping costs exclude these charges unless explicitly stated otherwise.

Payment of Shipping: Any expenses derived from shipping or payment methods will be borne by the buyer unless otherwise agreed in writing.

9. Right of Withdrawal

Where the buyer is a consumer purchasing at a distance, the right of withdrawal may be exercised within fourteen (14) calendar days, in accordance with applicable law. To exercise it, the buyer must notify Stylobike 2010 S.L. by WhatsApp or email; the cost of returning the product is borne by the buyer.

This right does not apply to products made or adapted to the buyer's specifications, to items collected in person, or to business and professional buyers.

10. Intended Use and Limitation of Liability

The products offered are intended exclusively for competition and closed-circuit use and are not approved for use on public roads. Any use on public roads is unlawful and made at the buyer's sole responsibility.

Products must be inspected and installed by a qualified professional before use. Stylobike 2010 S.L. shall not be liable for any consequence arising from improper installation, modification, misuse, or use of the products in a manner or context other than the one for which they are intended, nor for the risks inherent to competition use, which the buyer expressly assumes.

The liability of Stylobike 2010 S.L. shall in any case be limited to the amount actually paid for the product, and it shall not be liable for indirect damages or loss of profit. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law, including the mandatory statutory rights of consumers.

11. Modifications

Stylobike 2010 S.L. reserves the right to modify these conditions, with no retroactive effect on closed operations.

12. Applicable Law

These conditions are governed by Spanish law. The parties submit to the courts and tribunals of the consumer's domicile and, failing that, to those of the province of Barcelona.
